Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Sidecar Rolodex web application and companion browser extension (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

Sidecar Rolodex is a workspace that helps screenwriters organize producer contact information they personally gather, track outreach, and prepare email drafts through their own connected email accounts. The Service is a productivity tool only; it does not send emails without your explicit action and does not collect data from websites on its own.

2. Your Account

  • You must provide accurate account information and keep your credentials secure.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 16 years old and legally able to enter into these Terms.

3. Your Data and Your Responsibility

  • All contact information stored in the Service is provided by you. You represent that you have the right to store and use it for your outreach.
  • You are solely responsible for how you collect contact information and for complying with all applicable laws and third-party terms, including privacy, anti-spam (e.g., CAN-SPAM, GDPR) and solicitation laws when contacting people.

4. Third-Party Platforms — IMDb Pro, Google, and GMass

The Service interoperates with platforms we do not own or control. You understand and agree:

  • No affiliation. Sidecar Rolodex is not affiliated with, endorsed by, sponsored by, or partnered with IMDb.com, Amazon, Google, GMass, Gmail, or any of their subsidiaries or affiliates.
  • Your accounts, your responsibility. Any IMDb Pro, Google, or GMass account you use with the Service is yours. You are solely responsible for your use of those platforms and for complying with their respective terms of service, usage policies and rate limits, including IMDb Pro's terms regarding access to and use of its content.
  • We do not scrape. The Service does not access third-party websites on its own. The browser extension only organizes information from pages you personally open in your own logged-in browser, at your direction.
  • Third-party actions. We are not liable or responsible for any action a third party takes against you, including the suspension, limitation or termination of your IMDb Pro, Google, GMass, Gmail, or email account; enforcement actions; content removals; or any dispute between you and any third-party platform.
  • Third-party availability and changes. Third parties may change or discontinue their services, APIs, or terms at any time. We are not liable for any resulting interruption, degradation, or loss of functionality in the Service.

5. Acceptable Use

You agree not to:

  • Use the Service to send spam or unsolicited bulk email in violation of applicable law.
  • Use the Service to violate any third-party platform's terms of service, or to automate unauthorized access to any website.
  • Harass, threaten, defame, or unlawfully discriminate against any person through outreach managed with the Service.
  • Attempt to access other users' data, probe or scan the Service's security, or interfere with its operation.
  • Resell, sublicense, or provide the Service to third parties as a competing offering.

We may suspend or terminate accounts that violate these rules or applicable law, with or without notice.

6. Email Drafts and Outreach

Drafts created through the Service land in your connected mailbox and are sent only when you choose to send them. You are the sender of every message. We make no guarantee of deliverability and are not responsible for how recipients, mail providers, Google, or GMass handle, filter, or block your messages.

7. Intellectual Property

The Service, including its design, code, and branding, is owned by us or our licensors. You retain all rights to your own data and content. You may not copy or reverse-engineer the Service except as permitted by law.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF CONTACT DATA, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTREACH WILL PRODUCE ANY PARTICULAR RESULT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SIDECAR ROLODEX AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY CLAIMS CONNECTED TO GOOGLE, IMDB, GMASS, OR ANY OTHER THIRD PARTY, OR ANY ACTION TAKEN BY A THIRD PARTY AGAINST YOUR ACCOUNTS. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless Sidecar Rolodex and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your stored data, your outreach messages, or your violation of these Terms, applicable law, or any third party's terms.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms. Sections 4, 7, 8, 9, and 10 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a new "Last updated" date. Material changes will be highlighted in the Service. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
